tel aviv. the fighting between israelis and palestinians escalated overnight. the latest details next. also we hear from the family of a san jose marine shot and killed by southern california police. and san francisco sheriff ross mirkarimi defies an order from mayor ed lee. what mirkarimi says he won't do. a live look outside from the south bay before the sun comes up. that is san jose. expect some rain on the way. christina loren will be here to ll us on this friday, november 16th. this is "today in the bay." good morning, everybody. it is 4:30. i'm jon kelley. >> and i'm laura garcia-cannon. the bay area is on storm watch this morning. it is the first of a 1-2 punch for wet weather for the entire area. >> to talk about that, meteorologist christina loren joins us from our weather center. she's been tracking the system all morning long. >> hey, good morning to you. let's get right to the radar

this morning because that really shows you where the showers are coming down. for the most part they're sneaking up, pushing from south to north from san francisco into marin county. starting to get some pretty good activity at this point. we'll continue to see some light showers for the first part of the day. we are headed toward heavy periods of rain into tonight. what i can tell you is of the two systems that will pass through the bay area, the first one is going to pack a much stronger punch. we'll talk about how much rain is expected in your city, how long these showers will last and what it means for your early thanksgiving travel plans. that's coming up, 4:31. first let's check your drive on a friday. >> i'm also on storm watch so we're watching the skies over san jose. the speeds are all right right now but we do have an accident south 87 passing kurtner. sounds like everything is off to the shoulder but i see slowing on the northbound side so there must be something for a distraction. also light south 880 although

you see a little slowing, but the alameda off-ramp continues to be closed today possibly in through saturday. they're finishing work on that repair for the underground pump to prevent some flooding. that rain is coming so we'll watch for developments through the south bay because they still haven't reopened that and fixed that drain. we'll see how it plays out for the rest of the south bay and the vicinity. speaking of that rain, mike, this morning some daly city residents are worried this morning's rain might further weaken part of the hillside that collapsed earlier this week. we've got new video just shot this morning where emergency crews are shoring up the area to make sure it holds. it collapsed early tuesday morning after a pipe from a water storage tank above it just burst. coming up at 5:00 this morning, we'll hear from one of the peep eliving in that area and what crews are doing to ensure the neighborhood's safety. our storm watch continues all morning long with live weather and traffic updates throughout the day. be sure to check the latest conditions any time on our

website as well, nbcpayarea.com. happening right now a brand new round of attacks between israel and hamas. this is a live look at tel aviv where air raid sirens are going off citywide. overnight a cease-fire in gaza completely lapses. both sides accuse the other. now, at the same time israel targeting 150 rocket launching site its and ammunition warehouses in gaza as militants fired dozens of rockets into israel. right now israeli troops, tanks and personnel carriers gathering at the palestinian border prompting speculation of an invasion there. we will continue to follow this story throughout the morning and bring you live reports starting in our next half hour. 4:34 this morning the family of a san jose marine shot and

killed this past weekend is grieving his loss. 22-year-old allan devillena was remembered. >> it's too much. too much nan our hearts. >> i couldn't believe it, man. he was just with me last tuesday and now he's gone. >> police say devillena got into a scuffle with officers. a man sentenced to death for killing a san francisco state graduate nearly 30 years ago will have his execution date set today. robert green fairbanks pleading no contest for the 1985 death of wendy cheek. he's been on death row in san mateo county since 1989 but multiple appeals have delayed his sentencing from being carried out.

today a judge will schedule the execution. the last execution in san mateo county happened back in 2005. the husband and wife accused of killing a woman inside her home in hercules expected to enter a plea today. darnell and tania washington were arrested near seattle last month. prosecutors say they killed susie ko, then stole her car and fled to washington state. the couple had been on the run since august when tania allegedly helped darnell break out of prison in san bernardino. today's hearing is at 1:30. an emotional plea from an east bay mother this morning for thieves to return the ashes of her baby son. that urn containing those ashes was stolen from her home earlier this week. now, the mother says she just wants them back, no questions asked. her infant son died at birth earlier this year. she says the urn was engraved with his name, gabriel, and the date of his death.

now, those thieves also made off with her televisions, jewelry and christmas presents she had bought for her other children. >> that's very sad. it is 4:36 right now. a registered sex offender recently found volunteering is now banned from stepping foot on church property. the 51-year-old was convicted of molesting a young girl in 2010. he was spotted at the fall festival by a person who knows his victim. a parent told security at the festival. that parent was told he was allowed to be there because of a letter giving him permission. turns out the law allows registered sex offenders at school functions with permission. >> there's a statute in the penal code where basically what it says is a registered sex offender can be on school grounds as long as they have written permission from a school official. >> sheriff investigators are trying to verify that letter. a diocese spokesperson would not

say who gave him permission to volunteer at the festival. this morning san francisco sheriff ross mirkarimi refusing to give up oversight of his department's domestic violence program. mirkarimi made the announce naent a letter to mayor ed leer. that was in response to calls to mayor lee asking mirkarimi to give up control over those departments. he said he will let his undersheriff handle any disciplinary actions involving anyone in his department accused of domestic violence. he is on probation after pleading guilty to a misdemeanor, the result of an argument where he bruised his wife's arm. 49ers head coach jim harbaugh expected to be back on the field today as the team prepares for its monday night game against the chicago bears. harbaugh underwent a minor procedure yesterday to correct an irregular heartbeat. the team said he started experiencing chest pain on

wednesday but the procedure was mainly precautionary. in the meantime there's no official word on whether or not quarterback alex smith will be cleared to play in monday's game. he suffered a concussion last week. >> we wish both gentlemen very, very good health. pitcher brandon mccarthy officially has been cleared to resume normal baseball activities. less than three months ago, remember that's such a scary scene. he had to undergo emergency brain surgery after being hit in the head with a line drive. at this point he is planning on playing catch next month and if all goes well, he will start throwing bullpen sessions sometime early next year. so happy to see he is back on his feet and feeling there. >> there we go. feeling good about the forecast? well, if you like rain, you will be. let's check in with meteorologist christina loren. >> i've been pretty good about the forecast. i've been up studying it most the night and i have a pretty good handle on when the heaviest

showers are coming through. maybe you're trying to get out of town, it's going to be dicey for today. we will get the severe punch today and then a secondary storm as we head throughout sunday into monday. a colder storm not packing as much moisture. so right now the showers are moving from south to north. look, as i widen out for you, we've got a lot more on the way. a pretty strong batch of weather is going to arrive sglujust in for the morning commute. look at all the rain on the way for your evening commute. moderate to heavy rainfall at times all the way from 7:00 overnight. highs today are going to be rather cool compared to yesterday but not too bad because we're starting out nice and mild. 66 in livermore, 62 in concord and 64 in san francisco. i'm going to take you through the entire futurecast and show you when our next rain comes through and what this means for your weekend plans. if you're traveling within the state of california, stay tuned because we want to make sure you're aware of what you're getting yourself into.

let's check your drive with mike inouye. >> good morning. if you're looking at getting into oakland 880 moves smoothly past the coliseum. the northbound on the taillig s taillights, southbound with the headlights. no problems for the nimitz. we'll look at the toll plaza and the maze on the maps and we see a smooth drive heading to the toll plaza. heading away from that area, eastbound 24 is unusually slow to the caldecott. nothing reported as far as any disruptions. i'll track that and do further investigation and see if there's any reason for this. palo alto looking nice for the peninsula as well. 101 northbound with the headlights past university, a light flow throughout, but that rain is coming in so we'll track that morning commute. be careful, guys. back to you. one of san jose's big holiday attractions opens later today. downtown ice returns to the circle of palms on market street right across from christmas in the park.

on apple's mapping system. plus superstorm sandy and the fiscal cliff doing a number on the stock prices. for that and more we turn it over to seema mody for all of your business news. seema, good morning. >> reporter: everything you need. very good morning to you, guys. let's take a look at the markets first. futures lower after stocks continued their downward trend. the markets are now down 5% since election day. investors are measuring the risk of the economy going over the fiscal cliff and impact of hurricane sandy. reports shows manufacturing and economic activity fell in new york state as outages knocked out factories. in terms of how the markets ended yesterday, the dow fell 28 while the nasdaq lost about 10 points. in other news, the map app battle between apple and google is heating up. google is putting out the final touches on a new app that will

work on apple phones. if it's accepted into itunes ill will compete with apple's new soft more. apple removed google maps as a standard app when it released its latest software in september. but that move back fired as consumes complain apple's map app is majorly flawed. back to you. >> thank you very much. we'll check back a little later on. this morning we're getting a sneak peek at the format of the upcoming steve jobs movie starring ashton kutcher. it will be made up of just three scenes. first the release of the first mac. second is the lead-up to the launch of jobs company and third before the launch of the ipod. no other details being given and the trailer has not yet been released. jobs, the movie, is scheduled to open sometime next year, 2013. >> definitely looking forward to

that. jobs always did his presentations in threes. maybe there's something to that. right now we know there's a lot to the weather. >> sneaking in. >> you didn't notice me, did you? >> i hike that move. good morning to you, it's friday. we can have a little fun on a friday because this is probably going to put a damper on your good times outdoors this afternoon. the rain has now arrived and it's going to come in steadily throughout the day today. but we're expecting the heaviest rainfall overnight into early tomorrow morning and then we'll get a little bit of a break. right now you can see showers creeping up from south to north. our first system is approaching from the south so it's not all that cold. as we head throughout tomorrow we'll see steady rain until about midnight and then showers will start to deteriorate and we'll get some sun. we stop the clock at 2:00 p.m. on saturday. nice, sunny conditions for most of the bay area before our next system arrives.

this one will move through very quickly it looks like saturday night into sunday. just a really quick punch of cold weather and quick round of showers. then we have a third system on the way for the busiest travel day of the year. 66 in livermore, 64 in fremont and 65 in redwood city. you probably don't need the heavy winter court but temperatures will be a touch below average for this time of year. let's talk about the extended forecast. thursday of next week kind of a big day, big eating day. 64 degrees on thursday. i think we'll be nice and clear on thanksgiving but between now and then we've got a lot of rain to g through. the first storm is the most severe of the two that are going to come through first. rain early on saturday, partial clearing by sunday. we'll get a few showers monday and then tuesday and wednesday. starting to clear out of here. by thursday you're enjoying a little football outside with your family during halftime if that's what you like to do.

god bless you, laura. back over to you. >> she just needs a little bit of water. safe to say it's been a pretty rough week for former cia director david petraeus, today answering questions for the first time since he resigned for that affair. but this morning's hearing not focused on that. instead lawmakers want to know exactly what he knows about the attack in libya that killed four americans. tracie potts has new details on the closed door hearings. >> reporter: after three-hour briefing from the cia and the fbi, today both the house and senate intelligence committees will hear from former cia director, david petraeus. >> he interviewed many of the people, as i understand it, that were involved. and so the opportunity to get his views i think are very important -- is very important. >> reporter: the closed door hearing is not expected to get into the affair that prompted petraeus to resign. the cia is now investigating whether he did anything wrong

professionally. the fbi concluded it was a personal matter. >> we made the determination as we were going through the matter that there was not a threat to national security. >> reporter: petraeus testifies today on the deadly attacks that killed four americans in benghazi. thursday lawmakers saw a real-time video of that attack and got in a heated shouting match over whether united nations ambassador susan rice intentionally misled the public. >> this administration, including the president himself, has intentionally misinformed, read that lied, to the american people in the aftermath of this tragedy. >> if you want to know who is responsible in this town, buy yourself a mirror. >> reporter: petraeus could shed some light on that today. tracie potts, nbc news, washington. 4:51. coming up, they're going

make some sweet music marching right to new york city. ♪ that's a nice way to get your day started. they have been invited to play in the macy's thanksgiving day parade. nice work there, ladies and gentlemen. last night a little final rehearsal before flying out to the big apple. that parade will be the very first national event for saratoga's band. >> i am very excited, to the point where there's not a lot of sleep going on. i'm nervous. the kids are going to be fantastic, but i'm just worried that we are preparing ourselves for the kids and making sure we do a good job as teachers. >> what was that they were hitting on the -- >> drum sticks? >> it sounds cool, the clicking in the back ground. the clicker, thank you, there, mike. the band and chaperones will be

heading to the construction zone. westbound showing slowing through the caldecott but that has cleared up so likely some crews are on the move right now. >> thank you very much. it is 4:56. embattled cal football coach jeff tedford getting much-needed support from an nfl star. green bay quarterback aaron rodgers said tedford deserves to keep his job. he played for tedford at cal and said the school would be losing the greatest coach in history if they made a change. cal is in the middle of a dismal season with a 3-8 record. it is 4:56 right now. police looking for help finding the man who walked right into an apartment and attacked two women. we'll show you what he looks like coming up next. plus the bay area airport is getting ready for what it considers one of the busiest travel days of the year.
